This Privacy Policy informs you of our practices regarding collection, use and disclosure of information you may provide or Svelte Collective, Inc. (“Svelte Collective”) may collect via the Site. Please be sure to read this entire Privacy Policy before using or submitting information to the Site. We respect your privacy, and we are committed to protecting your personal information. The provisions of our Terms and Conditions apply to this Privacy Policy as well. All references to “we”, “us”, “our”, or “Svelte Collective” refer to Svelte Collective Inc. The term “you” “your” or “user” refers to the end-user of the Site, which includes all users visiting the Site and/or making purchases on the Site. By accessing and using the Site, including making purchases on the Site,you agree with the terms of the Privacy Policy. Whenever you submit information via this Site, including while making purchases on the Site, you consent to the collection, use and disclosure of that information in accordance with this Privacy Policy. Svelte Collective reserves the right to modify the Privacy Policy, at its discretion and without notice to you. Please review the Privacy Policy from time to time to stay up to date with any changes.

This Privacy Policy is intended to comply with the California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (“CPRA”).

I. Information We Collect From You

Personal Information

“Personal information” is information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer or household. “Personal Information” further includes “Sensitive Personal Information ” such as social security number, driver license number, state identification card, passport number, financial data, genetic data, biometric data, precise geolocation, and racial and ethnic origin, content of consumer communications (email, mail, or text), unless the business is the intended recipient, genetic data, and information collected concerning a consumer’s health, sex life, or sexual orientation. We do not collect Sensitive Personal Information.

*Svelte Collective stores the information we collect about you for as long as is necessary for the purpose(s) for which we collected it and in accordance with applicable law and legitimate business interests. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Svelte Collective respects the privacy of children, and does not knowingly or intentionally collect Personal Information from children under age 18. If you are under the age of 18, please do not use the Site, or submit any Personal Information through this Site.

Categories of Sources of Personal Information

Below are the sources from which we may receive your Personal Information:

We obtain the personal information listed above from the following categories of sources (i) directly from you (for example, through information we ask from you when you purchase products on our Site, or when you request to receive communications from Svelte Collective); (ii) automatically directly and indirectly from you when using the Site (see Section II below); or (iii) from other sources, such as third-party marketing partners.

 II. Information We Collect Automatically As You Use the Site 

We collect information automatically through the Site, such as how you use and interact with the Site, data on activities that you pursue through the Site, and other similar activities. This information is used to provide you with the Site, to better understand our users and how they use the Site, and to improve the Site. This information may include Personal Information, including your IP (internet protocol) address and your geolocation. 

The Site may collect such information through the use of cookies and navigational data:

  • A “cookie” is a bit of information that a website sends to your web browser that helps the site remember information about you and your preferences.
  • A “web beacon” is used to monitor your behavior when you visit a website, such as recording whether you have viewed a certain webpage.

Other Anonymous Data We Collect

When you use and visit the Site, we may also use third-party services, such as Google Analytics and others, which, as mentioned above, use cookies to collect generic, anonymous information that does not identify you (see above for more information on cookies). Do Not Track Signals

We do not track you or collect your information across third party websites or online services. Thus, we do not receive Do-Not-Track signals, or other similar signals. To the extent that we do receive any such signals, we will not comply with them as it is not an aspect of the functionality of our Site.

III. How We Use or Share Your Information

We may use or share your Personal Information for the business or commercial purposes described in this Section. 

  • Process and fulfill orders (“Orders”) for our products and services on the Site;
  • Present you with information through our Site and email services;
  • Maintain and improve our Site, as well as our products and services;
  • Respond to your requests and provide customer service, including responding to any problems that may arise with your Order, or any difficulties in navigating our Site;

Our Personnel And Vendors

To be able to effectively provide you with the Site, and to improve the functionality of the Site, we may disclose your Personal Information to our employees, contractors, agents, vendors, and other similar persons or entities, to the extent that such persons or entities have a need-to-know such Information in furtherance of the Site.

You may exercise certain privacy rights related to your Personal Information (to the extent provided for in the CCPA and/or CPRA). You may exercise these rights free of charge except as otherwise permitted under applicable law. We may limit our response to your exercise of these privacy rights as permitted under applicable law.   1. The Right to Know, Access, Rectify, and/or Delete Personal Information

Where the CCPA/CPRA applies, you may have the right to know, access, correct, and/or delete Personal Information about you which we have collected.

The Right to Know/Access: You have the right to know the information contained in this Privacy Policy and to request access to a copy of the Personal Information that Svelte Collective has collected about you directly or indirectly, including Personal Information collected by a service provider or contractor on our behalf.

The Right to Correct: In certain circumstances, you have the right to request correction of any inaccurate Personal Information. Upon verifying the validity of a verifiable correction request, we will use commercially reasonable efforts to correct your Personal Information as directed, taking into account the nature of the Personal Information and the purposes of maintaining your Personal Information.

The Right to Delete: You have the right to request that Svelte Collective delete your Personal Information, subject to certain limited exceptions. For example, we may retain an archived copy of your records consistent with applicable law, to continue to provide our Site and products and services, or for other legitimate business purposes.

  1. The Right to Opt-out of the Sale or Sharing of Personal Information or De-identified Personal Information

We do not sell personal information. However, we share your Personal Information with third parties to help us use your Personal Information. In particular, we use third parties to improve our ability to identify visitors to our Site. As part of this service, we may make available identifiers to these third parties, including your:

  • Email address;
  • Order transaction total;
  • Date of your Order;
  • Billing name and address;
  • Shipping name and address;
  • Customer IDs;
  • Tags;
  • Internet protocol address (IP address) 

We, and third parties, use this personal information to obtain more information about our users and reach out to them through other channels, such as email and/or direct mail.

We do not collect Sensitive Personal Information.

  1. The Right to Non-Discrimination

We will not discriminate or retaliate against you for exercising these consumer rights, including by (a) denying you goods or services; (b) charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; or (c) providing you a different level or quality of goods or services (or suggesting that we will do so).

Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Further, California Civil Code Section 1798.83 states that you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. Please note that we do not disclose your personal information to any third parties for their direct marketing purposes, except for any Client whose Event you have registered for, in which case the Client may use your personal information for their direct marketing purposes. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

 VI. Storing Your Information

Storage and Retention Of Your Information

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your Personal Information. 

We cannot, however, ensure or warrant the security of any information you transmit to Svelte Collective or guarantee that your information on the Site may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. As such, we will not be liable for any loss or damage you incur as a result of a breach of our security systems. In the event that Personal Information is compromised as a result of a breach of our security systems, we will promptly notify those persons whose Personal Information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law. S retains the Personal Information we receive as described in this Privacy Policy. We will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for. In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with you) in which case we may use this information indefinitely without further notice to you.

Security

We use reasonable efforts to secure your information and to attempt to prevent the loss, misuse, and alteration of the information that we obtain from you. For example, we will require our personnel to sign confidentiality agreements that extend to your Personal Information; we review the privacy practices of new products and services that we integrate into our Site; we train our personnel on privacy issues; we will have personnel to monitor privacy issues; and we restrict access to your Personal Information to individuals within and outside of Svelte Collective who need access to such information to provide the Site. In addition, we rely on the technical safeguards provided by the third-party vendors we use to host, store, and process your information. However, you acknowledge and agree that loss, misuse, and alteration may occur despite our efforts to protect your information. We are not responsible to our users or to any third party due to any such loss, misuse, or alteration. 

VII. Government Requests

From time to time, we may receive requests from government agencies to obtain information about our users. In handling such government requests, we greatly value the privacy of your information. While we may be required to turn over user information at times, we will strive to require a search warrant or subpoena, to the extent that we can reasonably demand such warrant or subpoena, before we turn over information about you and we will also strive to notify users when we receive government requests about their data. 

VIII. Third Party Practices Are Out of Our Control

Our Site may utilize numerous third party services as part of the functionality of the Site, such as hosting services, analytics providers, communications services, and other vendors; and we may share your information with third parties to the extent explained in this Privacy Policy. Additionally, we use third party payment processing services, such that we do not receive any of your sensitive financial information. We have no control over such third parties. Thus, we make no guarantees about, and assume no responsibility for the information, services, or data/privacy practices of third parties, which may differ significantly from our practices described in this Privacy Policy. We encourage you to review the privacy practices of such third parties to the extent possible, and we encourage you to use caution in deciding the information you choose to make available on the Site. 

IX. Canadian Users

This Privacy Policy and its enumerated policies are intended to comply with Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”) and provide appropriate protection and care with respect to the treatment of all of our Users’ Personal Information in accordance with PIPEDA, as applicable.

Any request for access or complaint about our handling of Personal Information under the PIPEDA must be made in writing and sent to us at the email address or physical address below.

X. Text Messaging Policy

The federal Telephone Consumer Protection Act (“TCPA”) and related FCC regulations shield consumers from unwanted telemarketing. The TCPA regulates the sending of commercial messages via telephone, text messages, and fax. Specifically, the TCPA makes it unlawful for any person to place a call or text using an automatic telephone dialing system or an artificial or prerecorded voice without the called party’s prior express consent, except for emergency purposes.

Text messaging, also known as SMS, is one method that Svelte Collective uses to communicate with those users who submit their phone numbers. 

Text Messaging

By submitting your phone number and agreeing to this Privacy Policy, you agree to receive Svelte Collective text messaging alerts (“Text Messaging Service”). Svelte may send periodic texts that could include marketing and non-marketing information. Consent to receive non-marketing or marketing text messages is not required to purchase any products or services from Svelte Collective. Messaging and data rates may apply.​​

Authorization

You certify that you are authorized: (a) to enroll the designated mobile phone number in the Text Messaging Service and (b) to incur any mobile message or data charges that may be incurred by participating in the Text Messaging Service. Check your carrier’s plan for details.

Subscribing to SMS Alerts

You may subscribe to the Text Messaging Service by entering and submitting your phone number in the provided submission forms available on our Site (collectively, the “Form”). By entering your phone number, completing the Form, and submitting the Form, you consent to receive text message communications from Svelte Collective as described herein. A text message will be delivered to the mobile number you provided confirming your enrollment once you have submitted your mobile number. You are responsible for managing the types of text messages (whether SMS or MMS) you receive.

By subscribing to the Text Messaging Service, you expressly consent and agree to accept and receive marketing and non-marketing communications via text message to your mobile device and to the mobile number(s) that you provided to us. Additionally, you consent to our use of an automatic telephone dialing system to generate the text messages to you.

Frequency of Text Messages

The number and frequency of text messages sent to your device may vary depending on your relationship with Svelte Collective (for example, if you have enrolled in a Svelte Collective program), and whether you have asked for help or support via text messaging.

Termination

Svelte Collective reserves the right, in its sole discretion, to cancel or suspend any or all of the Text Messaging Service, in whole or in part, for any reason, with or without notice to you.

Changes to Text Messaging Policy

Svelte Collective may revise, modify, or amend the terms of this Text Messaging Policy at any time.

XI. Changes to this Privacy Policy 

Svelte Collective reserves the right to change this Privacy Policy from time to time, with or without notice to you. Any changes to this Privacy Policy will become effective on the “Effective Date” indicated above. If you continue to use the Site after the Effective Date, you consent to the new Privacy Policy. Svelte Collective will always have the latest Privacy Policy posted on the Site.
